Approximately, how much money can an attorney get you if your injured in a car accident?

I had created x-rays done just a month prior to the accident, and my neck was fine, the disc have slid causing major pain. I’m unemployed i really know I can’t get loss of wages, but I had been in the act of searching for employment and after this I can’t think I could even find a job within my field, because of my injury. I additionally was at the operation of moving, again I can’t do that now. I had full coverage and gap insurance and they didn’t even pay back things i owed around the car. The sad part about all of this it wasn’t even my fault.

I just settled an auto accident. I used to be able to find the max from your coverage of the people who hit me. Here is the answer to just how much just about anyone will get. If someone merely has 15/30 thousdand..you will not read more than the per person limit. If they have 100/300 you will get as much as 100 thousand. You can read more should you be hurt badly enough. I settled my accident for your drivers max, and am now suing my own, personal insurance company under this plan I ensured I needed as a lower income single mom to guard myself. I have had 4 mris, cat scans, suffered thru nerve testing, 3 spinal injections, cortizone shots, months of physical rehabilitation and have PTSD which I visit weekly therapy. I gained 50 pounds, lost 2 jobs over this accident and other issues lost with precious family time. Most lawyers will require a 3rd. It really is worthwhile. I created a lawyer to my case and settled my daughters. It is just a pain, and now we finally settled her soft tissue for 14,300 with us trying to pay back my PIP insurance at a 2/3rd discount. So she is going to end up having just under 10 thousand (which goes in a trust none individuals can touch until she is 18). My settlement with the drunk driver was 100, a third went to lawyer. To anyone wondering the things they will could get..recognize how much insurance the one who hit you has, just how much insurance You’ve got, and what kind. Expect it to consider 1 to 3 years to stay. Remember, you cannot acquire more than simply how much insurance the one who hit you has. To the mom in the child needing cosmetic surgery..I’d see a lawyer asap. The treatment depends on what much insurance they’ve, but I would think your daughter would receive hundreds of thousands. Whenever they don’t have enough insurance, you’ll be able to sue them..most owners provide an umbrella policy something like that. If person who hit you merely has minimal insurance and zip of value court action for..you’d be doomed. This is why the insurance plan you carry is really important. In case you have under insured motorist..that may cover the other driver didn’t plenty of insurance for.

    I have read most of the above stories about how ppl have gotten hurt in a auto accident. I was in an Auto Accident last year in Sept.2010 My sister was the driver n i was the passenger, I got hurt the most yet my sister got a car within 2 weeks. I was also insured under her insurance. I have a lawyer at this time but I’m not getting told who am I suing, their using my ins to pay for my medical bills, when i feel it should be the other person who hit us pay for what actually me, I have been thru. I now have to used briefs to sleep because I cannot hold my urine n like I told the doc n lawyer it’s like talking to a wall. it’s only been 4 mnths and I’m wondering if I’m able to get another lawyer n let go of this one. He’s suppose to be a great lawyer but too me I don’t see it. I finally got my MRI results back and their not good at all. I found out that I have 6 disc bulges on my neck. I have gotten surgery before on my back n it was a bulge disc at first then it turn into a herinated disc. The Chiropractic tells me oh it’s nothing to worry about their just give me shots, I always take them for my back “woooooooo I have took over 100 already”??? Well, Hello there is him!!! He doesn’t know how my body feels, and me talking to the person that is in charge of my lawyer doesn’t tell me much either but just too wait until i see the doctor . I’ve read my report n according to him yeah he’ll give me shots but if those don’t work then he wants to give me surgery.. Sorry!!!! but I’m not getting surgery!!! No way n for the shots i don’t think I’m getting those either. I have gotten 4 shots in my back from my last surgery in April of last year before my back surgery n it did not work, I’ve gotten them on my hands also n nothing again. I know my body they are not me to tell me oh yes it will work, blah blah blah. According to my sister they only found 1 budge disc on her shoulder, and she said i’m not getting no shots, no no no. enough is enough I’m just gng with grandma which she’s an Indian healer and let her do my neck too. lol My grandma is 80 yrs old n she has heal many ppl i know she can heal me too. I don’t know what the lawyer or doctor will say when i tell them I’m not going to get the shots because to me that’s a waste of time and too dangerous and I’m not taking no chances not on my Neck.Oh yes one more thing when we first went there one of the person that represents the lawyer told us the limit was $60,000 and now we’re told it’s only 30,000!!!! Haaaaaaaaaaaaaa I don’t think so I think we are being ripped off. But then again I’m not sure bc i really don’t know about anything like this. I never been thur something like this and it really sucks if that’s what their doing. So, when i go see my doc I’m going to give him the news n I’m sure he’s going to be calling my Lawyer. I just have to wait until that day to come and it will be very soon. If anyone knws anything and can help me please do. Thanks and God bless you!

    My parents were involved in a serious accident on April 2011. A red light runner going around 35-40 mph clipped the front of my Mom’s car and caused it go spinning out of control. As a result. my Dad broke his neck and required surgery to repair his neck and a 5 day stay in the hospital. My mom bruised her ribs and sprained her ankle. We hired a lawyer who tells us the other driver only has a 15/30K policy and they are offering my parents $30,000. I feels that is not enough because my Dad could have been left paralyzed or even been killed. Luckily he wasn’t left paralyzed but is suffering pain and having difficulty swallowing even to this day. We have the option to sue the other driver, but I don’t know if we should do that, Our lawyer tells us that if we sue and win, that the other driver doesn’t even have to pay if he doesn’t want to or can file bankruptcy thus making our law suit worthless. We are really stressed out and don’t know what to do.

    Hello everyone i recently got into on accident the other driver did a left turn on a intersection when I was going trough it on a green then turn yellow light she impacted my car an totaled it. I am worried about my spine because I have e ruptured disc on my lower spine. The lady’s Insurance know there driver was at fault and she got tickets. I don’t understand why they denied to give me a rental car if their driver was at fault. My car value was at 48,000 dollars plus I had to pay for my own rental car till i ran broke,I am about to loose my job because of my back and no car to try to go to work. The Hospital that attended me on the day of the accident told me i was ok but i was in a lot of pain then i went to a Chiropractor they told me I was ok too so I went to another Chiropractor and they told me my Lower Disc was rupture bad 7mm. they told me i need surgery but there is a disc because of the disc that got fractured. does anyone know if i got a good case.

    I was re ended in 2003, 8 years later my lawsuit has not ended and still on going…..my advice to all of you seeking a fast payout, you may get worse!

    I am unable to work, I’m suffering from depression,,fatigue, anxiety as a result of the accident. I’ve been to countless dr’s over the years. For the past 4 years I receive between 10 to 30 injections into my back and neck on a weekly basis, not to mention the medication that has given me some pretty bad side effects.

    Not once have I thought about how much money I would get. All I think about is when will I be myself again! No amount of money can compensate me for what I have lost over the years, I am no longer the person I was. My children have been robed of a mother as my husband’s been robed of his wife.

    Looks like some insurance companies are waiting for people to die! I was 28 years old and in the prime of my life, active, hard working, determined. Now it’s a challenge to get out of bed most days, keeping up with my children is difficult . Sometimes, I don’t leave my house for days.

    My experience with the insurance company has been nothing but stressful! They are multi billion dollar companies for a reason. If you’re looking at suing be sure to know that your entire life will become an open book, just so they can nit pick and try to put the blame on something else. RUTHLESS IS WHAT THEY ARE.

    I was in a car accident were the other driver was at fault and in a business vehicle. My car was totaled and I have a pinched nerve in my back, messed up my soft tissue in my back, and now I have acute bladder/ bowel dysfunction. (basically I don’t know when I have to go) My question is how much do you think I’ll get? The guy at fault was insured for 1 million dollars.

    L4-L6 i have a diffuse bulging of the disc effecting the thecal sac

    Got in a accident Dec 2010. went to chiropractor for 5 1/2 months last day i went the chiropractoe called ambulance to come get me. Could not move and it was screaming pain… I have bad nerve from neck to right arm,herniated disc in neck, 3 herniated disc in lower back, pinched psyyiatic nerve in back and right leg. Accident was not my fault. Could someone please give me some idea what I may get If i sue. The other driver is a company vehicle and they have 500,000.00 coverage.note: no previous accidents or medical history. Thank you

    I was in a car accident on 4/30/11 it was the other drivers fault and the cops gave the driver the ticket i was hurting but i did not go to the tell that night and i went to the urgent care. Then they just side i have will get over it and then it was geting bad and then i got a lawyer they told me to go to physical therapy then i went to get x rays and MRI then i went to a Dr. And i was told i have to have sugary to fix my back and i did that on 7/21/11 and the driver only had 25 and the driver in my car has 50 so what could i be coming home with and can i sue the driver in the other car after I take the other insurance to court thanks

    May 13 2010 I was a passenger in my mothers car when we got rear ended. Results, I herniated 3 out of 7 discs in my neck, had an epidural and 8 injections in series. Released after therapy Aug 2010. March 3, 2011 on my way to my daughters FFA show we T boned a guy that crossed traffic without any visual. It was his fault he got the ticket. I reherniated one of my discs in my neck, have nerve damage, numbness and severe sharp pains in my head and migranes due to pressure on my neck. I am currently back in with the chiropractor going to pain management again. It smashed our 05 chevy 4×4 like a beer can, totaled it and we payed close to 30,000.00 for this truck and after 1 1/2 months we finally get 9,000.00 back for it. I cant express my feelings in a classy manner on that subject. My daughter who is only 85 lbs soke and wet was the passenger and the airbags deployed on both of us and burnt her arm up and cut mine pretty bad. She messed up her rotator cuff and is currently in therapy. This is the same insurance company as the one we are currently in litigation with. Since I had a pre existing injury am I entitled to anything?

    My Son got into a car accident with the nanny! It wasn’t her fault. It was a pretty intense one though. My 2 year old son walked away feeling fine, and playing around, however later in the evening I touched his neck and he said owee! I took him to the chiropractor today and he said my son for sure has tension in his muscles from the accident and needs treatment 2 times a week for a few weeks and then 1 time a week for awhile. My son is also a little scared in the car. He pluggs his ears every time. The nanny thinks its because of the wreck. The nanny suffered from the accident with neck and shoulder sprain, so here is the rest. I found out that my nanny was driving her brothers car and the car was not insured. Now she will loose her license and probably not be able to watch my children. I am in school full time and will have to repay my loans and grants because of all this.. Will my son get any settlement? Even though the nanny is more injured then my son? Any advise??

    Hi, My name is Samuel F., I was recently in a car accident on September 21, 2010. I has a p.o.s 1988 Ford Escort GT stick shift with the lowest form of PA insurance, just liability and limited Tort.
    Well i work mon-fri 7-330pm all year round. i left work early one day, around 1-2pm, so i can go to my doctor for Allergy meds. I checked out there being just fine with my scripts in hand and i was, secretly from my job, going to a scheduled interview to an Amazon Wharehouse. Well, i was more than halfway there when an oncoming car made a left turn right in front of me at the last second, i slammed my brakes and honked my horn up until i collided with the very center of this huge work van of an electrical contractor. Upon impact, my face had smacked against the steering wheel and my rear window, only the rear window, shattered. I remained conscious and managed to jump outta of the passenger side window because there was so much traffic outside of the driver’s side door. I was holding my chin the entire time. Witnesses noticed i was bleeding and quickly gave me some paper towels. The driver of the van that had cut me off approached me and asked, “Are you ok?”. Mad as i was i still kept my temper and didn’t curse him out. I asked, “What did you do that for?”. He said “I didn’t know there was another lane there, I didn’t see you coming.”. Thats when i ran to my car, that had severe front end damage, and took my cell phone out of the car. Then, i looked into my side mirror and noticed that tremendous gash on my chin. I was then taken to a nearby hospital in an Ambulance and i was setup for stitches. The ER doctor, being professional and all, managed to sew my chin back together with 13-14 stitches on the outside and 3- dissolvable ones in the inside. Anyway, i contacted a Layer’s office that same night because i was determine to sue for my damages due to road Negligence of another driver.

    Anyway, my Attorney, exactly 6 months of the accident, didnt hardly say a darn word to me when i went to his office. He took a few pictures of my chin and shook my hand and said we’ll be in touch. He called me a few days ago, about 3 weeks after the photos were taken, and told me that we are looking at 40k maybe 45k with this case ‘as is’. Well i’m due for plastic surgery in a week but thats not going to remove the permanent scar thats on my face for life. Plastic surgeon mentioned that this procedure will lower the swelling but it wont do much more.

    So even with cheap insurance on your car, its mostly about how good the person at fault’s insurance is and how bad the damage to yourself also is.

    My lawyer is taking 40% of my money but honestly i dont care because if it were up to me, the first offer of $15 grand from the Adjuster would’ve been taken. now i’m getting roughly about $25,000 and i believe, due to it being permanent facial scarring, I wont have to pay any taxes on my setlement.

    I was droping off a guy from work his brother in law started acting crazy did not get out or say anything to the Guy he blocked us from leaving went around him then he chased us onto the road hollering he was going to kill us then passed me on the right shoulder of the road and intentionally side swiped me then took off cops charged him with hit and run $2333.00 in dameges to my truck went to the er and have been going to chiropractor for 8 weeks mid back pain and neck don’t know how much more treatment any body know what I might be entitled too

    i was injured badly in a accident on nov. 26 2011. i was a passenger in the front seat. my girlfriend and her sister were fussing and my girlfriend jerk the wheel and we flipped 3 times and slided into the medium. my right forearm arm was busted up with a deep roadrash, deep cuts on the wrist, and hemotopa to the back of the head. painful healing process and im wondering how much can i get paid from injury.

    Back in December of 09 me and my family were in a car accident where a armored vehicle hit the front of my truck. Everyone felt fine but then they sent me and my husband to therapy and found out that my husband now has two hirneas due to the accident and he might need surgery due to the accident. So the therapy assigned us a lawyer who hasn’t told us how much he will charge. Also my husband can no longer work in the oil fields anymore and we need help. Do you know how much we can get from this? Also how much do the attorneys get?

    My medical bills are up to about 23,000 right now. And i was in the back seat of a friends car and a person ran the red light and hit us. Right after the accident i was having problems with controling my urine and i have a back injury. My statues are about to run up on monday so i was trying to get the insurance company to settle at a reasonable price before then…but there being assholes. (excuse my language) So now i guess i have to file suit. But they were talking about giving me 15,000 dollars.But i felt thats not enough. Because thats not going to pay my bills and i had to quit my job bc of this. I found a new job and just got fired bc of this. smh i need some assistance im only 22 and dont know what to do… :(

    hi guys i was rear ended by a 16 yr old girl 7 months ago.. i have shoulder and lower back pain almost daily.. was diagnosed with back and neck strain at the hospital the day after and had to see my personal dr a month later for the pain i felt… i was offered 1250 from the insurance for pain and suffering should i settle or get a lawyer. i live in delaware.

    i was hit by a dodge ram 3 times in september of 09, a drunk guy hit me then i got dragged down the street for about 25 yards then my leg slid under his wheel and it ripped me off the truck then he backed over me and then peeled out over the top of me.i suffered broken back, pelvis, femur, ankle, ripped all the skin off my right leg and had big holes in my right foot and roadrash everywhere. i still deal with alot of pain everyday does anyone have any idea what im going to get from my settlement?

    I had my truck at a friends home,was staying in their camper because of being homeless. On Dec.1st 2010 I was sleeping inside camper with spouse I had just had a total hip replacement (11/22/10),spouse was sleeping in the front of camper on couch. As we are sleeping the other driver was coming down their driveway (home owner) it was a long driveway and the other driver said that he was having a seizure and drove his wifes Ford Explorer down the side of my truck,he was going so fast that it litterly picked the truck up moving appx. 5/6 feet causing the truck to slam into the camper and it knocked me out of the bed in the back of camper. They said that our insurance had to pay for all damages to the truck. When we called our insurance they said we did’nt have comp. coverage,and also it happened on personal property,and they were suppose to pay for all damages,and owner of Explorer had to provide us a rental car. Well I have already seen my drs,and they have some damages to me,and my spouse has had some medical problems,but has no medical coverage and already has hospital bills from his heart attack in 2008. But he still need to be seen by dr. So now we just got a place to live 1/5/11 and they are not going to pay for anything,no damages for truck which was totaled by Body Shop ($4890.00) of damage and if we try to sue them they will file bankruptcy.I had to cancel ALL my appts for physical therapy(which) was required by The Dr that had just done surgery on my hipreplacement, long story but WE (me&spouse) are still suffering,I also am Disabled due to a serious medical problems. PLEASE HELP US. we both live on SSD and can’t afford Attorney. Just any help would be very very much help. Thanks for letting me vent,I’m not doing well. PS: Driver did go to the hospital and there were no signs of any seizure or anything wrong,nothing wrong with him. WE think they are cons,due to other things that happened while staying there,and we did pay the elect. bill every month,and other things.

    I recently had spinal fusion of C-5 through C-7 and still have 3 more dics that need to be replaced later. I have a plate w/ 6 screws in my neck and an ugly scar.
    My lower back also has a herniated disc S1/L5 and I was diagnosed w/ mild scoliosis in highschool. My hips are completely out of line and I use a lift in my left shoe to balance myself, though it doesn’t help much. Now my left leg is shorter than my right leg. I suffer from extreme pain in my lower back and it goes numb if I stay in one position for to long (i.e. 30 min.)
    My neck is still hurting and causing extreme pain down my right shoulder blade. My left arm/hand is completely numb and has remained numb since being rear ended. My face (lower jaw/teeth) and neck are still numb since have my anterior spinal fusion which was done in dec. 2010 (I was told this wasn’t normal and the doctor would keep an eye out for it) I am scheduled for my follow up xrays next month, already had one set done in jan.
    I have given my deposition and my lawyer (an auto injury/medical experience lawyer) has not given me any info on a dollar amount for settlement. I am wondering approx. what I may receive? He did state a lot earlier in my case before we knew the extent of my injuries that it was a seven figure case. This accident was not my fault and happened in 2008.
    My car still isn’t fixed right and that whole thing is just a mess.
    Anyway, does anyone have any approximates on a settlement amount? I am out of work, going on 8 months now because I was told by my treating dr. to stop working (I could barely walk). I have filed for disability and should be getting an answer on this any day now (met with the SSI doctor 1 1/2 weeks ago).
    My husband is permantly disabled due to a motor cycle accident that left him brain injured and he almost died from it. Spent 1 yr. in the hospital and 2 yrs. in physical therapy learning to walk, talk, eat, etc. So, as you can see my income was a main support to our family.
    Any help would be appreciated even though I realize it’s just opinions and would not be my real dollar amount in the end.

    HAPPY as heck, i was brrrroke!
    lol and i am so thrill i had a great attorney sure he deduct,at his office table in nj
    his”cut”and i mean a whopper of a big cut lol like 25 to 30 percent i think as i was not mad. i got left over with a GREAT windfall for some 1 who was 2 month
    late in rent,(i have a lease,hence i was not kick out)as i now paid it and i was so happy! i had suffer from driving in another person car,a taxi at that,the dumb drunk guy run a stop sign,and smash hard,making the taxi driver hit a curb some witness also see it,as the corner camera,big brotherwatching!
    i was able to get within Five short months.(three weeks ago)before lawyer fee
    i won/settle for AFTER chiropractor great treatment five months straight.3 MRI
    done.i won such right to during settlement of almost 40 grand! i was so glad.

    I work for a cable company while installing cable in Mcdonalds I slipped and fell in the back by the fry machine. turns out the employee was mopping but didnt get the puddle of water(about a inch) up. I couldnt move 911 was called went to e.r…I tore UCL in both thumbs…and so far neck/lumbar strain(aggravated pre-existing injury)…had surgery(fusion) on lumbar 2006. Both thumbs need surgery..given the info…just the injuries can bring about how much in P.I. claim?

    I have been going to the chiropractor since august 23 2010 my disc are moved in my back and also my hips are not aligned ! I was a a stop because the police were coming it was a green light, a car hit me from behind. In the sight of the police! My truck was fixed (4567.82 damage worth) ! But I lost 2 of my jobs because of the recovery time off!!! How much should I be looking at?

    Hey I was diagnosed with PTSD and I was unable to drive my daughter because prior to the accident (moments later) I had just took her out the car seat and right after the accident happen I had forgot that I didn’t have her there and I panicked and I was afraid to drive her anywhere with me. It was beginning to be a problem so my fiancee told me to inform me doctor and she referred me to a psychiatics who later told me that I had PTSD from the accident… There was months and months that I didn’t drive my daughter in the car, we missed so many special events and mother/daughter time because of it. I’m not at all money hungry. I am a nurse and I am not that type of person but something needs to be done about this. What do you think my lawyers will settle for?

    All of this confuses me, I have never been through this before but i was in a car accident a few months ago and my little girl was injured pretty bad she had to be taken to a childrens hospital & had plastic suregery on her face due to injurys her medical bills are 28,000 and still going to doctors IM NOT ALL ABOUT MONEY at all but my 3 year old didnt deserve to go through this and im seeking as much as possible for her, i have heard since her bills were so much that she probably will not get a settlement all she will get are her bills paid is there any truth to that?

    i was in a car accident here in new jersey last january 1 2010.new year morning go figure.but i was ok afterward when i settle lol. i settle FAST well fast to me was few months first office,around the third to fifth month in 2010.
    i had no mri,but i ask for one cause i was in so much pain,but later find out the ER dr.should have cause i was injure,and i was entitle to file lawsuit due to the fact i have also here in new jersey FULL TORT lord know i pay enough for it and with full tort?your able to sue NO MATTER WHAT I ABSOLUTELY LOVE IT,IF I HAVE A PAIN INJURY ETC. SIGNIFICANT OR LITTLE HAND FOOT NECK PAIN I AM GETTIN PAID.
    PERIOD.SO FULL TORT IS WORTH IT TO PAY MORE.I HAD A $15/30,000 on my bodily injury.now i raise it after this to 100,000/200grand bodily injury anyhow

    was hurt.i sued,i did not wait a year to settle was rather great,for soft tissue injury not bad at all.as i still have some pain.

    so i do want to share what happen

    . i was broke,ALMOST FLAT BROKE.WORK WAS LAYIN’US OFF AT POST OFFICE.

    i am healthy great person mother of 2 boys 1 girl
    all teens.
    i am italian american.

    young older woman in my late thirties almost forty but VERY healthy always.

    drink or smoke nothing for entire life. i was driving in a cab service/taxi car,

    and WHAMO!a lady white tall brunette,wit son in her car age around 10~

    she PLOW right thru and i was hurt as soon as she struck the taxi,

    i was badly hurt internal

    stomach pain,back neck shoulder,left hip*same side she ran into us!)
    up and down the leg shoulder back area mid and lower back. i was in pain,

    but the X-RAY MRI etc.
    WAS NEVER CONDUCTED by the lousy suburban dr. at the nearby hospital. i was told i feasibly have a liability claim against the emergency dr. who barely look at me,he made me wait for at least 1 full hr.to be examine,he just”look in my eye
    say i am ok”but have some MUSCLE back and neck seriosu spasm goin on etc.

    i was so mad he barely look at me,give me few hours bedrest in E.R.
    then i go home.

    Chiropractor locally said i am hurt. i was happy to hear it cause i get a hefty well for me a big settlement for as they are callin it a “soft tissue” but around more the
    neck upper area,and lower mid back too! spinal lumbar something was messed up
    and sayin how the ER dr.should have examine me so i am suing him too.but that is still pending.

    i started chiropractor when the pain KEPT comin’back somewhat.and feelin dizzy et.
    11 days after the car taxi accident.and i been going ever since,from january 1 2010
    till around five short months. i was feelin better by the six month before that actual
    four/five mos.and the insurance company start talkin’a full settlement i went from
    flat broke.job huntin,to relax now wit my big fat nice check for my soft tissue back
    neck injury,and i was offer may 2010 1st offer is for $15,500 even.if i agree i am told i get check within the next business day.i REFUSE,but i did take the 2nd offer i had to wait another month or two,and i was HAPPY i took it for my soft tissue back
    and neck injury five months of straight chiropractor NO MRI DONE/NO CATSCAN
    but PROOF OF CONSISTENT NEVER MISS BUT ONE CHIRO APPT.i was able to get
    a total of 43,000 BEFORE lawyer fee(s)so i was told i should have did this myself but still i had settle for this amount.almost forty five thousand bucks?not bad at all.

    i brought home almost $27.500 or somethin like that i am VERY happy and paid my
    rent first time in entire life a year advance since last july aug till this year july 2011
    and still have Thousands growing interest in bank,and able to relax finally and i am satisfied to settle my claim get big nice amount in this economy with the insurance
    people,

    they KNEW IT WAS THE DRIVER FAULT SO THEY HAVE TO SETTLE EVEN
    MOR SO WHEN THE ATTY.SAY IT IS THE DRIVER FAULT,here in new jersey
    ny tri-state i am so happy,and merry xmas to all and have a happy new year
    and buckle up! i had my buckle on,help me alot i am told or could have been
    flung across the seat. whiplash,soft tissue,spinal lumbar,etc. all came to take home pay within few months. not over five months almost 28grand after lawyer fee
    now i see i could hav feasibly did it on my own but i am still happy and i am at least debt free for years to come,and want to start a small biz,since rent paid in full all
    year.good luck to all suing for soft tissue injury.just keep at least $15/30,000 grand
    bodily injury,and FULL TORT OPTION let your family sue for any, get cash for any
    injury OR little pain.etc. i am happy i had it.

    i was in a car wreck with a girl i know she was the driver, it was a single car accident, it fractured my thoracic spin it fratcured 2,3,5,6 and also broke ribs 5,6,7 and brusied my lung and set up infection on it, i was wondering if i even got a lawsuit and about how much i would get out of it if i did sue, or if i could even sue, this is my first wreck that i have actually been injured in…thanks

    So I have a question I hired craig swapp and associates. I was in a car accident the driver was a seventeen year old girl whom was at fault. I had my two daughters with me and one of them i took to the hospital complaining of neck pain but neither of them were honestly hurt i had some pretty severe wiplash they gave me four shots of cortizone the day after the accident and then I had to see a chiropractor for two months afterwards. My medical bills rounded up to be about 5,000. How much do you think I will get from my settlement not including the medical bill? Im just curious

    This isn’t enough information. Were you only seen in the ER? Are you treating with an actual doctor? Or are you just going to a chiropractor? I don’t mean to be rude but looking for employment doesn’t necesiarly mean that you’d find employment. The general rule of thumb is that professional employment takes three months to find and start. Min wage jobs can be found in much less time.

    If you only went to the ER, had xrays and got some meds with no followup treatment, you’d probably get your medical bills paid for plus $500-$1,000. Another good question is why did you have xrays one month prior? That signals that you were most likely already having issues or that you have had neck/back problems in the past.

    The people that have “mega-settlements” are usually the ones with “mega-medical bills.” You don’t go to the ER and treat with a chircopractor for six months and get $100,000 because you couldn’t find work while doing so. Also, you shouldn’t expect any settlement until all of your treatment has been completed.

    And finally, the normal rate (nationwide) for accident attorneys is 33.3% for non-trial and 50% for trial work. The majority of them never go to trial because the majority of the cases are soft tissue neck/back injuries. What attorneys know how to do is (1) negoitate with an insurance company and (2) negoitate lower medical bills with providers. The question is will your attorney share the proceeds from reduced medical bills with you or will he/she just treat that as more profit for the law office? If you have a simple neck/back chircopractic claim with no surgery and a six month treatment plan, then an attorney might create another $2k onto the claim payment; however, remember that they will take 33.3% of the whole thing.

    Bottom line: Don’t expect to get rich because you see attorney ads on TV showing people waving $100 bills around. The purpose of those ads is to get you to come to their office. While at their office, they will make the insurance company sound terrible and talk big about $30,000+ settlements. Eventually, you’ll get some money and he/she will get a third of it. As for the car, I think that’s already been addressed. Gap insurance covers the difference between the value of the car and the loan on the car up to certain interest rates and it does not cover other loans taken out on top of the car loan.

    Approximately, an attorney would tell you that. It depends WILDLY on which state you are in, who is at fault, what the exact injury is, the cause of it, the consequences, etc.

    If you were FINE, then WHY did you need x-rays done a month before the accident? SOMETHING was going on, so you’ll have to prove that it was accident, and not whatever the other problem was.

    Also, they don’t OWE the payoff on your car, they only owe what your car was WORTH. If you overborrowed, and paid 85% interest, and rolled another $100,000 of debt into the loan, that’s not THEIR fault!!

    If you can’t work in “your field”, you will have to switch fields. Most people do, many times, over the course of their career.

    Bottom line – this claim very well might not be worth anything at all.

    The amount will depend on the amount of insurance carried by the party at fault, and if you are the cause of the accident ,lots of luck, as the lawyers will of course take the easy and quick way out. The lawyers usually work on a %30 basis, so if there is not much potential for a large settlement, very little attempt will be made on your behalf.
    A judge can order any amount, but collecting is another matter.

    Blood and broken bones are key in accident settlements. Find a doc that will confirm a whip-lash injury and you can make out pretty good. I wouldn’t give an attorney more than about 30 percent, as that is about the going rate. Some wont even take the case if there was no blood or broken bones. They say its not worth it to them.

    What kind of GAP insurance did you have? That’s the purpose of the GAP, it pay’s the difference, If you have a valid policy sue em’,

    Pain, suffering and loss of lifestyle claims are difficult to access, each is different and insurance companies are loath to pay out anything in under a year,

    A guy I worked with a few years back received a 45-k settlement after being rear-ended and suffering spinal damage that required surgery,

    Here’s the rule of thumb — IT WORKS WITH OR WITHOUT AN ATTORNEY ASSISTING YOU.

    - Add up all of the medical bills incurred thus far.
    - Add up future medical bills to correct your situation.

    If the total amount incurred is less than $5,000. Then multiply the total by 3. That’s what you’ll get.

    If the total amount incurred is more than $5,000 but less than $10,000. Multiply by 2.

    If the total amount incurred is more than $10,000 but less than $25,000. Multiply by 1.5.

    If the total amount incurred is more than $25,000, then hire an attorney.
